बिल्डरों ने डकारा निवेशकों का पैसा

फरीदाबाद। सरकार के खिलाफ लामबंद होने के बाद अब गे्रटर फरीदाबाद के निवेशक, बिल्डरों के खिलाफ मोर्चा खोलने की तैयारी में है। निवेशकों को एक आरटीआई के जवाब में पता चला है कि सालों पहले उनसे वसूला गया ईडीसी (एक्सटर्नल डेवलपमेंट चार्ज) सरकार के खाते में नहीं पहुंचा है। निवेशकों की शिकायत पर चंडीगढ़ में बिल्डरों के खातों की जांच चल रही है।
टाउन एंड कंट्री प्लानिंग विभाग ने पिछले वर्ष ईडीसी बढ़ाने की घोषणा की थी। इसको लेकर बिल्डरों की तरफ से निवेशकों को नोटिस भी जारी किए थे हालांकि निवेशकों ने इसका विरोध जताते हुए अदालत का दरवाजा खटखटाया था। निवेशकों ने एक आरटीआई डालकर विभाग से पूछा था कि कितना पैसा किस बिल्डर ने अब तक ईडीसी के रूप में जमा किया है। पिछले साल दिसंबर में आरटीआई का जवाब मिला तो इसने निवेशकों को हैरत में डाल दिया। निवेशकों से पूरी राशि वसूलकर बिल्डरों ने मात्र ५० फीसदी रकम का भुगतान ही सरकार को किया। आधी रकम के भुगतान में देरी के चलते सरकार ने ब्याज लगाना शुरू कर दिया। गे्रटर फरीदाबाद वेलफेयर एसोसिएशन के मीडिया प्रवक्ता अजय यादव ने बताया कि पिछले साल जो ईडीसी बढ़ाई गई, उसके मुताबिक निवेशकों से मात्र ५० रुपये प्रति स्क्वायर फुट वसूला जाना चाहिए, लेकिन बिल्डरों ने १५० रुपये प्रति स्क्वायर फुट के हिसाब से नोटिस जारी किए। इसकी शिकायत टाउन एंड कंट्री प्लानिंग विभाग के निदेशक टीसी गुप्ता तक पहुंची तो उन्होंने पिछले दिनों विभाग की एक ऑडिट टीम को बिल्डरों के खातों की जांच के लिए भेजा। टीम ने खातों की जांच कर ली है और चंडीगढ़ में इसका आंकलन किया जा रहा है। निवेशक अगले सप्ताह एक बार फिर से निदेशक से मुलाकात करेंगे और बिल्डरों की मनमानी पर नकेल कसने की मांग करेंगे।

फरीदाबाद. नहरपार निवेशकों के लिए ईडीसी (बाह्य विकास शुल्क) गले की फांस बन चुका है। एक ओर नहरपार पंद्रह सेक्टरों का विकास करने वाले बिल्डरों ने सरकार के कई करोड़ रुपए बकाया रखे हुए हैं, दूसरी ओर निवेशकों से तय ईडीसी से अधिक वसूले जा रहे हैं। इसका खुलासा आरटीआई के तहत हुआ है।

नहरपार ग्रेटर फरीदाबाद वेलफेयर एसोसिएशन ने टाउन एंड कंट्री प्लानिंग डिपार्टमेंट में आरटीआई दायर की थी। इसके जवाब में एसोसिएशन को बताया गया कि ईडीसी के रूप में बिल्डरों को सरकारी खजाने में 1600 करोड़ रुपए जमा कराने थे। लेकिन, बिल्डरों ने महज 846 करोड़ रुपए ही जमा कराए हैं। इतना ही नहीं जवाब से साफ है कि सरकार की ओर से तय ईडीसी से ज्यादा निवेशक से बिल्डर वसूल रहे हैं।


गौरतलब है कि बिल्डरों की मनमानी से परेशान निवेशकों ने कई बार जिला स्तर से लेकर सरकार व सीनियर आईएएस अधिकारियों तक गुहार लगाई है। मामला गंभीर होता देख हाल ही में टाउन कंट्री प्लानिंग के डायरेक्टर टीसी गुप्ता ने जांच के लिए एक ऑडिट टीम का गठन किया।

इसके बाद चंडीगढ़ से आई टीम ने नहरपार लाइसेंसशुदा बिल्डर्स के दफ्तर में औचक छापेमारी की। छापेमारी की कार्रवाई कर टीम 28 जनवरी को यहां से वापस गई है। इस दौरान टीम ने ईडीसी से संबंधित रिकॉर्ड को जब्त किया और निवेशकों की शिकायतें भी ली। रिकॉर्ड की जांच के लिए टीम ने एक सप्ताह का समय मांगा गया है।


2005 से नहरपार ग्रेटर फरीदाबाद को विकसित किया जा रहा है। नहरपार सेक्टर-75 से लेकर 89 तक सेक्टर काटे जा रहे हैं। फिलहाल डेढ़ दर्जन से अधिक बिल्डर सक्रिय हैं। लगभग 7500 एकड़ जमीन पर डेवलपमेंट कार्य के दायरे में है। इसमें 2500 एकड़ जमीन निजी बिल्डरों के अधीन है। हुडा को यहां 75 से लेकर 89 तक 15 सेक्टर विकसित करने हैं।


इसके अलावा इन सभी सेक्टरवासियों की सहुलियत के लिए हुडा ने 1072 एकड़ जमीन पर मास्टर रोड बनाए जाने की योजना तैयार कर चुकी है। वहीं, बिल्डर ईडीसी वसूलने के बावजूद विकास के कार्यो को लेकर गंभीर नहीं दिख रहे। निवेशकों की मानें तो तय ईडीसी से अधिक की वसूली के उन्हें धमकाया जा रहा है। कुछ बिल्डर्स बिजली सब स्टेशन और सीवरेज ट्रीटमेंट प्लांट लगाने नाम पर भी निवेशकों से वसूली कर रहे हैं।

When these builders show us the public documents which no way clarify the queries which we ask them (be it about interest computation on EDC or Electricity and STP calculation), so why not share this public document from our end with them. Just a suggestion...others may please add on...

All you are aware that on the complaints of GFWA and personal meeting of GFWA members with Sh. T.C.Gupta there was one Audit team came to FBD and audit team checked and verified the books of builders.

That was in the last wk of Jan'12, but till date there is no action from town and country plng dept on that audit report.
(reason best known to all of us).

During my recent discussion with one of News paper editor I highlighted this issues and also told about the inefficiency of T&CP dept.
Secondly, I told him that all builders are carrying malpractice and even for non-payment of EDC (unjustified demand), builders started issuing threatening letter to customers.

'सपनों के घर' की तलाश में ग्रेटर फरीदाबाद में निवेश करने वाले लोग अब खून के आंसू रो रहे हैं। किसी ने बैंक से कर्ज लिया तो किसी ने पिता के फंड के रुपए फ्लैट में निवेश किए। लेकिन छह साल बाद भी उन्हें फ्लैट मिलना तो दूर रहा, कैंसिल करने के नोटिस भेजे जा रहे हैं।ऐसे में हजारों निवेशकों पर अब संकट के बादल मंडरा रहे हैं। नहर पार लगभग 50 हजार निवेशकों ने रुपया लगाया है।

बिल्डर व निवेशकों के बीच क्या है पंगा : नहर पार ग्रेटर फरीदाबाद वेलफेयर एसोसिएशन के प्रवक्ता अजय यादव के अनुसार 25 मई 2011 को उनके पास बिल्डर की मार्फत एक नोटिस आया। इसमें सेक्टर की ईडीसी (बाहरी विकास सुविधा शुल्क) बढ़ाने की बात कही गई थी। उनका कहना है कि जब यहां डेवलपमेंट ही नहीं हुआ तो ईडीसी कैसे बढ़ा दी गई। ईडीसी 2005 से बढ़ाने की बात कही गई थी।उनसे सरकार ने डेवलपमेंट टैक्स के रूप में 150 रुपए प्रति स्क्वायर फीट के हिसाब से रुपए लिए थे। फिर उनसे 140 रुपए स्कवायर फीट के हिसाब से मांगे जा रहे हैं। उन्होंने कोर्ट के समक्ष याचिका दाखिल की है, जिसमें पहले दी हुई ईडीसी का हिसाब मांगा है। उनका कहना है कि जब एग्रीमेंट हुआ था, तो उसमें लोक-लुभावन वायदे किए गए थे लेकिन इन वादों पर कोई भी बिल्डर खरा नहीं उतरा। बावजूद इसके अब बिल्डर बढ़ी हुई ईडीसी के हिसाब से निवेशकों को पूरा भुगतान करने के नोटिस भेज रहे हैं। यह भी चेतावनी दी जा ही है कि ईडीसी नहीं दी तो फ्लैट कैंसिल कर दिए जाएंगे।

ऑडिट रिपोर्ट को दबाया : बिल्डरों द्वारा की जा रही मनमानी और अन्य कई गड़बड़झाले को लेकर जनवरी 2012 में टाउन एंड कंट्री प्लानिंग डिपार्टमेंट के मुख्यालय द्वारा किए गए ऑडिट की रिपोर्ट को भी दबा दिया गया है। इस रिपोर्ट को 30 दिन में ओपन करना था। यहां तक कि अब आरटीआई से भी इस रिपोर्ट के बारे में जानकारी नहीं दी जा रही है। सूत्रों की मानें, तो रिपोर्ट 15 बिल्डरों का गड़बड़झाला सामने आया है। डेढ़ दर्जन बिल्डरों के खिलाफ एक हजार से अधिक शिकायतें डीसी से लेकर सीएम तक दी जा चुकी हैं।

Great Effort, Ajay ! It is strange that many written complaints have been sent to DC, Faridabad yet he says that he is NOT aware of the matter. I was reading an article on ibnlive.com that mentioned how a whistleblower is being harassed by CM himself. It is time for administration to pull up socks and do something for middle class buyers who are aspiring for a home after paying huge amount of money to developers. Last thing they want is loot and exploitation by these builders.

great going Ajay, This matter is of great significance because
1] money collected as EDC is not deposited with govt
2] Congress led Govt has not cashed bank guarantee on default to pay edc
3] Congress Govt has allowed builders to use public funds at discounted rates to finance their business
4] No bank loans to these builders below 18% and Private equity players at 22-35% while govt charges only 12-15% penalty from builders
5] Revenue collected but not deposited with govt is of LAND REVENUE Nature and is the most serious crime in any civilised democracy
6] It is the first and foremost duty of any and every govt servant to ensure that public revenue is secured and collected. However, to the contrary, builders Like BPTP are being give status of REPUTED BUILDER and charged concessional 12% rate of interest.
7] This is a clear case of dereliction of duty by GOVERNMENT and all those serving it Despite 100s of complaints against the builders not remitting rightfully calculated funds to the govt.
8] Calculation of EDC is being manipulated by Builders and even bank guarantee charges and interests for non payment by builders are being apportioned to customers.
9] Charging of service tax on EDC and not depositing by Builders to the Central govt Authorities is the biggest crime. EDC is a govt levy and cannot be doubled taxed. Only income retainable by builders should be accountable for service tax.

DC/DTCP/HUDA are culprits and are abetting this serious and heinous crime at the behest of political masters and in cohoots with the builders. It would be right time to move lokayukt against these departments and officials with the help of RTI responses available with GFWA.

Apart from this all services are the liability of builders as a part of licensing condition very clearly written in the agreement of builders with DTCP. Still the builders keep harping about HUDA for not having provided facilities. Its astonishing that ever since the current Congress I govt has come to power not even 1%of the sanctioned covered area has been give Occupation Certificate and possession offered to homeseekers.

If the audit branch had been efficient enough, licenses would have been cancelled for many builders long ago and serious frauds like Triveni and DD township would not have happened.

Now to top it up, govt has given further leeway to defaulting builders by giving OC to 75% of licensed area against original 50% WHETHER OR NOT THEY HAVE PAID ANY EDC!!! https://docs.google.com/file/d/0B0CW4pu ... YwN0k/edit

What more proof is required by press or any investigating agency!!
