Owner’s plea for alternative plot from HUDA rejected

GURGAON: Punjab and Haryana high court rejected the petition of a woman seeking alternative plot in Gurgaon from Haryana Urban Development Authority (HUDA).

The petitioner had moved to high court in early this year seeking direction for HUDA office in Gurgaon to allot a plot. During the hearing on September 5, HUDA official had submitted an affidavit stating that the petitioner, Santosh Mehra was originally allotted plot number 276 in Sector 21, Gurgaon and subsequently, vide allotment letter dated July 28 1997, she was allotted an alternative plot no 294, Sector 45, Gurgaon.

The court was also informed that the petitioner, with permission of HUDA, had sold the said alternative plot to Piyush Gupta. At that time the HUDA had issued a re-allotment letter in favour of Piyush Gupta.

After issuing the re-allotment letter, the plot remained in the name of the second owner. In 2002, HUDA resumed the plot on account of nonpayment of the dues. According to the records of HUDA, the plot was resumed on March 4, 2002 and a cheque dated July 8, 2002, a refund of Rs 3,01,829 was made to the second owner Piyush Gupta.

The court was informed that the cheque was encashed by Piyush Gupta on August 16, 2002 and the plot was renowned by HUDA as per the procedures. After going through the written submission and affidavit, justice SK Mittal dismissed the petition.
