Punjab and Haryana high court stays FIR in land fraud case

Gurgaon: The Punjab and Haryana high court has rejected the petition of a man who fraudulently transferred ownership of an industrial plot in Rewari. The petitioner, Bal Krishan Garodhia, had approached the high court seeking quashing of the FIR registered against him in 2011 under different section of cheating and forgery with the Dharuhera police station near Gurgaon.

According to the prosecution, the plot had been purchased from the Haryana Urban Development Authority (HUDA), Gurgaon, by a company for the purpose of its development in 1978-79. The land was purchased in the name of the company by Garodhia with a clear understanding that the land will be transferred in the name of the company after it was formed. The court was also informed that at the time of the allotment, HUDA had issued the receipts in the name of the company.

The prosecution alleged that Garodhia, in connivance with HUDA officials, got the land conveyed in his name after a gap of 20 years. In order to get the land transferred, Garodhia had submitted forged documents in HUDA office. The land was then sold to another person and then the petitioner had misappropriated the sale proceeds.
