Thanks for your feedback and support. I could not locate these charges in agreement. I am reading now with lence and if found will let you.

Others-Please share if you noted any thing in agreement which can lead BPTP to collect these charges. You can be in touch @9313916314 for this issue to take to next step for action against BPTP.

Here is demand letter for additional EDC, STP and electric substation:-

"Please note further that vide Memo No. HUDA.CCF.ACCTT-I-2011/17903 dated May 25, 2011, the Government of Haryana has revised the EDC charges in respect to the licenses granted by the Director Town and Country Planning, Haryana (“DTCP”) in Faridabad w.e.f. 2005 retrospectively. In view thereof, the EDC amount payable by you against the said Plot also raised. The payment made by you on account of EDC was based on the interim rate applicable for the year 2005 of Rs. 1,024/- per sq. yd., which now stands revised to Rs.39.76 lacs per acre retrospectively w.e.f.2005. Thus, on account of the said increase, your EDC stands revised to Rs. 2,578/- per sq. yd. (Rs.3,083/- per square meter).

Further, as you are aware that Parklands is the biggest residential plotted colony being ever developed by a private developer in Faridabad in the Naharpar area and we are in the process of delivering the physical possession of flats, plots, commercial units and floors, in a phased manner all across the Parklands, Faridabad. In compliance of the various approvals and sanctions granted by various authorities for undertaking the development of the Parklands, Faridabad, we have been obligated to develop the Sewerage Treatment Plant as well as the Electric Sub-Station of 220 KV in the project and therefore as per the terms of the Plot Buyer Agreement we request you to further pay a sum of Rs.4,99,490/- towards setting up a Sewerage Treatment Plant and an Electric Sub-Station.

In view of the above, please find attached herewith the demand letter for revised EDC as well as the charges for setting up a Sewerage Treatment Plant and an Electric Sub-Station.

The statement of account including the demand as mentioned above is enclosed herewith.

You are requested to make payments as per the statement of account to avoid further accrual of interest and holding charges and we shall be executing and registering the conveyance deed of the above referred plot in your favour shortly after receipt of the complete amount."

just few things to note. as per Haryana development and regulation urban area act ,1975 these are the definition of External work & infrastructral work

External development works” include water supply, sewerage, drains, necessary provisions of treatment and disposal of sewage, sullage and storm water, roads, electrical works, solid waste management and disposal, slaughter houses, colleges, hospitals, stadium/sports complex, fire stations, grid sub-stations etc. and any other work which the Director may specify to be executed in the periphery of or outside colony/area for the benefit of the colony/area;

Internal development works” means-
(i) metalling of roads and paving of footpaths;
(ii) turfing and plantation with trees of open spaces;
(iii) street lighting;
(iv) adequate and wholesome water supply;
(v) sewers and drains both storm and sullage water and necessary provision for their treatment and disposal; and
(vi) any other work that the Director may think necessary in the interest of proper development of a colony;

as we see STP and grid sub station are already part of External work and internal work but BPTP want to show them seperatly and charge over and above of EDC and IDC charges.

we can jointly ask them why or file an RTI to ask Harayana Govt. whether this understanding is correct or not ?

Strangely, BPTP is NOT a part of New Faridabad Developers Association (NFDA) who are fighing Haryana Govt., HUDA etc. for doing external development works in Neharpaar (Greater Faridabad). BPTP does not have guts to fight Haryana Govt. but picking up their customers for cheating and making excessive unjustfied demands.

I believe since BPTP has monopoloy and holds dominant position in Faridabad, BPTP customers should unite and jointly pursue a case in Competition Commission of India (CCI) for cheating customers. Recently, Gurgaon Association won a case against DLF in CCI. A penalty of Rs 650 crores was imposed on DLF.

Dear Akhil,

Thanks for posting the letter online. Just a small query, what is the size of ur plot? First and foremost, ask BPTP CC for the following:

Calculation of this lumpsum figure?
Which clause in the agreement are they referring to?

All plot holders will be getting such letters in sometime, sooner or later. So, protest at BPTP office has to be done at the earliest. Or if you suggest that meeting DC or someone else for this makes sense than that can also be planned. Our first step is to get clarity on this issue of Electrification and STP charges. As far as increased EDC is concerned that is beyond BPTP and the High court case is taking care of that. So, focus for plot holders is the Electrification and STP charges payment at such absurd rates.

Dear Gaurav,

Size is 502 yard. Yes I am planning to send letter today to BPTP to ask these information. I am sending my rejection demand letter.

First to make every one aware about contract law (per me though I am not expert)
1. Contract is applicable from the date of exchange of hand (When BPTP issued to you and you have signed the receipt of contract) i.e it means that all payement demand before this date is illegeal and void and nill automatically., if you have not paid them.
2. As customer you are entitiled to rejectect any demand and ask for further details if you are not satisfied. Onus is builder for any delay further if he does not provide the detal, information requested by you within stipulated time in your letter.

All BPTP users should also meet DC,DTP in good number and have clarification.
Also send combined complaint to DTCP and cc to DTP,DC,CA-HUDA, FC&PA,CS-Haryana Govt too by mail and regd post..

In parallel also approach CCI as this is case of dominant player and misuse of clauses.

Thanks. Its very important to have a critical mass and then talk to the builder bcz as an individual they keep on fooling and don't pay any heed. So, for all these points, let us atleast try to have 50+ people (on a minimum) and then talk to them.

What I can count is that including you and me there are already 6-7 people, so let us start inviting interest fo a meeting with BPTP possible this week itself for these agenda points.
